Discipline protects public trust

Discipline is governed by the SALGBC Disciplinary process to ensure fairness, consistency, and legal compliance.

This includes:

  • SALGBC Main Collective Agreement
  • SALGBC Disciplinary Procedure and Code Collective Agreement
  • Labour Relations Act 66 of 1995 (Schedule 8)
  • Municipal Staff Regulations (2021)
  • MFMA 56 of 2003 ( Financial Misconduct provisions)

The disciplinary process covers:

  • Preliminary investigation.
  • Written charges.
  • Proper notice of hearing.
  • Right representation.
  • Independent chairperson.
  • Consideration of mitigating or aggravating circumstances.
  • Proportional sanction.

Immediate dismissal may result from fraud, theft, or corruption; gross dishonesty; gross insubordination; serious harassment or assault; gross negligence, and financial misconduct as described in the MFMA. All disciplinary decisions must be procedurally and substantively fair.

Ultimately, discipline protects public trust, financial integrity, and institutional integrity.
